1. What DbeatZ Is

DbeatZ is an AI music creation and community voting platform operated by Lovecraft LLC. You describe what you want, our AI (powered by ACE-Step) generates a unique track, and the community rates it through swipe voting (drip/drop). Top tracks climb the leaderboard.

2. Age Requirement

You must be at least 13 years old to use DbeatZ. By creating an account, you confirm you meet this requirement. If we learn a user is under 13, we will terminate their account and delete their data.

3. Your Account

One account per person. Don't share your credentials.
You're responsible for everything that happens under your account.
Provide accurate information when registering.
We can suspend or terminate accounts that violate these terms.

4. Music Rights — Who Owns What

This is the important part. Read it.

All music on DbeatZ is AI-generated using ACE-Step. Both you and DbeatZ retain rights to the output:

Your rights: You get a non-exclusive, royalty-free, perpetual license to use, distribute, and commercially exploit any tracks you generate on DbeatZ. Release them, sell them, put them in your projects — they're yours to use.

Our rights: Lovecraft LLC retains a non-exclusive, royalty-free, perpetual license to use your generated tracks for platform features — including displaying them in voting, leaderboards, promotional materials, and platform-wide playlists.

Neither party has exclusive rights. Both can use the content independently.

5. Content Rules

You're responsible for the prompts you write and the content generated from them. Don't use DbeatZ to:

Generate content that infringes copyrights or trademarks
Create illegal, abusive, or harassing content
Impersonate others or misrepresent AI content as human-created
Manipulate votes (multiple accounts, coordinated voting, bots)
Spam the generation system or abuse the free tier

We reserve the right to remove content and terminate accounts for violations.

6. Credits & Payments

Free tier: 3 track generations per day, no credit card needed.
Paid credits: Purchase additional generation credits via Stripe.
Payments are processed by Stripe. We never see or store your card details.
Purchased credits do not expire.
All sales are final. Refunds for unused credits are available within 7 days of purchase — email lovecraftllcapps@gmail.com.
If a track generation fails, your credit or free generation is automatically refunded.

7. Fair Play

The leaderboard is community-driven. To keep it fair:

One account per person. Creating alt accounts to inflate votes is a ban.
No automated voting, scraping, or API abuse.
No coordinated vote manipulation (vote rings, paid votes, etc.).
We use algorithmic and manual detection. Cheaters get banned.

8. Service Availability

DbeatZ is provided "as is." We aim for high availability but don't guarantee uninterrupted service. AI generation depends on GPU resources that may have cold start delays. We're not liable for downtime, generation failures, or the subjective quality of AI output.

9. Limitation of Liability

Lovecraft LLC's total liability to you is limited to the amount you've paid us in the past 12 months. We are not liable for indirect, incidental, or consequential damages.

10. Changes to Terms

We may update these terms. Significant changes will be communicated via email or in-app notice. Continued use after changes means you accept the new terms.

11. Governing Law

These terms are governed by the laws of the United States. Disputes will be resolved through binding arbitration.
